The Wholesaler collects Customers’ personal data for the purposes of business cooperation, including:

  • contact details: first name and surname, e-mail address, telephone number;
  • company details: company name, Polish Tax Identification Number (NIP), registered office address, Polish National Business Registry Number (REGON);
  • data provided through contact forms or requests for quotations;
  • data contained in correspondence.

§3. Purposes and Legal Bases for Processing Personal Data

The Data Controller processes personal data for the following purposes:

  1. preparing commercial offers in response to a customer’s enquiry or interest, on the basis of the Data Controller’s legitimate interests (Article 6(1)(f) GDPR);
  2. entering into and performing sales agreements with customers, where processing is necessary for the performance of a contract (Article 6(1)(b) GDPR);
  3. handling complaints and claims, where processing is necessary for compliance with a legal obligation to which the Data Controller is subject (Article 6(1)(c) GDPR);
  4. accounting purposes related to issuing and receiving accounting and settlement documents, where processing is necessary for compliance with obligations arising under applicable tax law (Article 6(1)(c) GDPR);
  5. archiving data for the purposes of establishing, pursuing or defending legal claims or demonstrating relevant facts, on the basis of the Data Controller’s legitimate interests (Article 6(1)(f) GDPR);
  6. communicating by telephone, e-mail, website contact form or messages sent through the Data Controller’s social media channels (Facebook, TikTok, Instagram), in particular in response to enquiries addressed to the Data Controller, on the basis of the Data Controller’s legitimate interests (Article 6(1)(f) GDPR);
  7. marketing, on the basis of the Data Controller’s legitimate interests (Article 6(1)(f) GDPR) or, where required, on the basis of prior consent (Article 6(1)(a) GDPR);
  8. operating social media profiles in accordance with the functionality and terms and conditions of the respective social media platforms, on the basis of the Data Controller’s legitimate interests (Article 6(1)(f) GDPR).

§4. Disclosure of Personal Data

Customers’ personal data may be disclosed to third parties only to the extent necessary to process and fulfil orders, including:

  • courier and transport companies;
  • payment service providers;
  • entities providing customs clearance services.

The Wholesaler does not sell or disclose personal data to third parties for their own marketing purposes without the Customer’s consent.

Personal data will be retained for the period necessary to perform the agreement and comply with applicable legal obligations. Following the end of the business relationship, data will be retained for the period required under applicable law, including tax and accounting regulations.

Customers have the right to:

  • access their personal data;
  • rectify their personal data;
  • request the erasure of their personal data or restriction of processing;
  • data portability;
  • object to the processing of their personal data;
  • withdraw their consent at any time where processing is based on consent, without affecting the lawfulness of processing carried out before its withdrawal;
  • lodge a complaint with the competent supervisory authority in Poland — the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych).
